What happened

Lower courts blocked the order before it ever took effect, and it reached the Supreme Court as Trump v. Barbara.

Where it stands

Struck down 6 to 3 on June 30, 2026. Five justices held it violates the 14th Amendment's Citizenship Clause; Justice Kavanaugh agreed it was unlawful, but under federal statute instead.

The administration's side

The administration argued these children are not 'subject to the jurisdiction' of the United States and that the current rule encourages birth tourism.
