The RecordExhibit 153
Naming his son-in-law an envoy for three wars, with no Senate confirmation and no financial disclosure
Pending means: In court or under criminal investigation right now.
In February 2026 Trump announced that Jared Kushner, his son-in-law, would serve as an envoy, and he has since negotiated for the United States in the Israel-Hamas, Russia-Ukraine and Iran conflicts without Senate confirmation or a public financial disclosure. On Oct. 14, 2026, the watchdog group Citizens for Responsibility and Ethics in Washington sued, arguing the arrangement violates the Constitution's Appointments Clause and federal ethics law.
What happened
Kushner solely owns Affinity Partners, an investment firm with more than $6 billion under management, about 99% of it from foreign investors including the sovereign wealth funds of Saudi Arabia, Qatar and the United Arab Emirates, with significant investments abroad including in Israel. CREW's 45-page complaint, filed in federal court in Washington against Kushner, the White House and several administration staffers, calls him one of the government's 'go-to foreign policy negotiators', working in Eastern Europe, the Persian Gulf and the Middle East, and brings three counts: that he exercises the powers of a federal officer without Senate confirmation, that he has not filed the financial disclosures the Ethics in Government Act requires of high-level officials, and that his private interests overlap with his government work; it adds that if he is a private citizen, exercising government power would violate the private non-delegation doctrine.
It asks the court to bar him from a diplomatic role until he is appointed and confirmed, to bar top officials from facilitating his work, or at least to order him to file disclosures for the period he has served. Kushner is unpaid and covers his own expenses, according to his lawyer and the White House. His role in the Lukoil asset sale is on the Watchlist (Watch 12).
Where it stands
Pending: the lawsuit was filed Oct. 14, 2026, and no court has ruled. CREW president Donald K. Sherman said Kushner should go through Senate confirmation and that the court must intervene.
The administration's side
Kushner's lawyer, Chad Mizelle, said the suit is without merit and that outside and government ethics lawyers reviewed Kushner's volunteer service and found it compliant. White House spokesperson Anna Kelly called CREW an 'unserious, Trump-deranged organization' and said Kushner's personal business is unrelated to his diplomatic work, and a White House official said presidents have used private envoys since George Washington.
