Bombing Iran without Congress, the first time
AllegedLast checked Oct 5, 2026
Alleged means: Serious, credible accusations of illegality that no court or watchdog has decided yet.
Operation Midnight Hammer sent B-2 bombers against Iran's Fordo, Natanz and Isfahan nuclear sites without congressional approval or advance notice to top Democratic lawmakers.
What happened
Lawmakers in both parties objected, including Republican Rep. Thomas Massie, who said Iran posed no imminent threat. It set the pattern for the far larger war launched in February 2026.
Where it stands
No court ruling; war-powers fights rarely reach one.
The administration's side
Rubio called it a limited mission to disrupt nuclear weapons development, not an attack on Iran or its people.
