Censuring Sen. Mark Kelly and moving to demote him over the 'illegal orders' video
Ruled unlawful means: A court ruled against it. Some rulings are on appeal.
Defense Secretary Pete Hegseth formally censured Sen. Mark Kelly, a retired Navy captain, and opened a review that could cut his retired rank and pay, after Kelly and five other Democratic lawmakers told troops in a video that they can refuse illegal orders.
What happened
The 90-second video was posted in November 2025, and Trump called it seditious behavior punishable by death (see the entry on that post). Hegseth's letter of censure, dated Jan. 5, 2026, said Kelly's statements undermined the chain of command and brought discredit on the armed forces, and it warned of criminal prosecution or further administrative action if he kept speaking that way. Kelly, whose 25-year Navy career included dozens of combat missions and four trips to space, sued on Jan. 12. Hegseth has said Kelly was the only one of the six investigated because he is the only one who formally retired from the military and so remains under the Pentagon's jurisdiction. Federal prosecutors separately asked a grand jury in Washington to indict the lawmakers, and on Feb. 10 it refused.
Where it stands
On Feb. 12, 2026, Judge Richard Leon, a George W. Bush appointee, barred the Pentagon from carrying out the censure or cutting Kelly's rank or pay while the lawsuit continues. He wrote that officials had 'trampled on Senator Kelly's First Amendment freedoms' and threatened the liberties of millions of military retirees. The ruling is a preliminary injunction, not a final judgment. Hegseth appealed. A D.C. Circuit panel heard arguments in May 2026 and signaled it would likely side with Kelly, Courthouse News reported. We found no report of a decision.
The administration's side
The Justice Department argued that Kelly, as a military retiree, does not have the same First Amendment rights as other civilians and can still be disciplined for speech that undermines military order, and that he had to take his complaint to a Navy records board before going to court. Hegseth called the video reckless and seditious and said the judge's order would be appealed immediately.
