Arresting students over their political speech

Ruled unlawfulLast checked Sep 30, 2026

Ruled unlawful means: A court ruled against it. Some rulings are on appeal.

ICE arrested Columbia graduate Mahmoud Khalil, a green-card holder married to a U.S. citizen, and masked agents later grabbed Tufts student Rümeysa Öztürk off a street, both over pro-Palestinian activism.

What happened

Trump called Khalil's arrest the first of many to come. Öztürk's main offense appears to have been co-writing a student newspaper op-ed. Khalil spent 104 days in immigration detention before he was released.

Where it stands

In AAUP v. Rubio, Reagan-appointed Judge William Young ruled that the policy violates the First Amendment, finding that Rubio and Noem acted together to deport people primarily for protected political speech.

The administration's side

The administration denies any ideological deportation policy and says the visa revocations followed long-standing immigration law.
