Handcuffing and charging Democratic officials

Sen. Alex Padilla was shoved to the ground and handcuffed after trying to ask Homeland Security Secretary Kristi Noem a question at her press conference.

What happened

Weeks earlier, Newark Mayor Ras Baraka was arrested at an ICE facility (the charges were later dropped) and Rep. LaMonica McIver was indicted for assault over the same scuffle. Federal prosecutors also charged a Wisconsin judge over an immigrant in her courtroom.

Where it stands

In August 2026 a divided appeals court panel ruled that the oversight visit doesn't shield McIver from prosecution, clearing the way for trial on at least two of the three charges, which carry up to 17 years. Democrats call the arrests intimidation of elected officials doing oversight.

The administration's side

DHS said Padilla didn't identify himself and that officers acted appropriately; video shows him stating his name and title. Officials say the other arrests enforced the law, and body camera footage shows McIver shoving at least one officer.
